By accessing EmojiKidz.com or purchasing, activating, or using an EmojiKidz® smartwatch, mobile application, subscription, or related service, you agree to these Terms of Service and the policies referenced within them. "EmojiKidz," "we," "us," and "our" refer to EmojiKidz®. "Customer," "you," and "your" refer to the purchaser, account holder, parent, guardian, or authorized user. "Services" include our website, devices, applications, subscriptions, cellular connectivity, GPS/location features, and related support services.

1. Products and Services

EmojiKidz provides GPS-enabled smartwatches for children with features that may include calling, messaging, GPS location, geofencing, SOS alerts, parental controls, and other safety and communication tools. Features may vary by device, service plan, network availability, and application compatibility.

2. Subscription Services

Certain EmojiKidz features require an active cellular subscription. Available plans, features, allowances, billing periods, and eligibility requirements are disclosed when you purchase or activate your service.

3. Fees & Recurring Billing

You agree to pay the price and applicable fees presented when you enroll. By selecting a recurring subscription, you authorize EmojiKidz to charge your payment method at the billing frequency disclosed at enrollment until the subscription is canceled. Applicable taxes and other required charges may be added.

4. Plan Changes

EmojiKidz may introduce, modify, or discontinue plans, pricing, features, or promotions from time to time. Changes affecting an existing subscription will be communicated as required by applicable law. The plan and pricing accepted at purchase or activation determine the terms applicable to your subscription.

5. Cancellation

Subscriptions may be canceled according to the terms presented at enrollment. Unless otherwise stated, cancellation prevents future recurring charges and service continues through the end of the current paid billing period. 6. Returns & Refunds

Eligible products may be returned in accordance with the EmojiKidz Return & Refund Policy applicable to your purchase. Returned devices must meet the stated return requirements and include required accessories. 7. Shipping

Shipping times are estimates and may be affected by carriers or circumstances outside our control. Shipping charges are generally non-refundable after an order has shipped, including returned, refused, or undeliverable packages, unless the shipping error was caused by EmojiKidz or a refund is otherwise required by law. 8. Lifetime Warranty / Replacement Program

Eligible EmojiKidz devices may qualify for our Lifetime Warranty and Replacement Program while an eligible subscription remains active and in good standing. The program may provide up to one qualifying device replacement during each applicable 12-month period, subject to eligibility requirements, exclusions, availability, and the warranty terms applicable to the program.

9. Proper Use of Device

EmojiKidz devices must be used according to the provided instructions and for lawful purposes. Devices may not be modified, reverse engineered, misused, or used in a manner that interferes with cellular networks, software, security features, or the privacy or rights of others.

10. GPS, Cellular & Location-Service Limitations

EmojiKidz devices depend on GPS signals, cellular coverage, battery power, network availability, and third-party technology. Location information, alerts, connectivity, and other services may occasionally be delayed, interrupted, unavailable, or inaccurate. Battery performance varies based on usage, settings, GPS activity, cellular coverage, and other conditions.

11. Voice, Video & Communication Features

Depending on the device and service, EmojiKidz products may support voice calls, video calls, messaging, voice chat, or other communication features. Parents and guardians are responsible for configuring approved contacts and ensuring these features are used lawfully and appropriately.

12. Parent/Guardian Responsibility

EmojiKidz products are designed to provide parents and caregivers with additional communication, location, and safety tools. A parent or legal guardian is responsible for establishing and managing a child's account, device settings, approved contacts, permissions, and appropriate use of the Services.

13. Emergency/SOS Disclaimer

SOS, GPS, geofencing, calling, and other safety features are supplemental tools and are not substitutes for appropriate adult supervision or emergency services. EmojiKidz does not guarantee that an alert, call, message, or location request will always be transmitted, received, or accurate. In an emergency, contact the appropriate emergency service directly whenever possible.

14. Privacy

The collection, use, storage, and disclosure of personal information associated with EmojiKidz websites, devices, applications, GPS/location services, and customer accounts are governed by our Privacy Policy. Parents and guardians should review the Privacy Policy before activating a device for a child.

15. Intellectual Property

EmojiKidz trademarks, logos, website content, software, designs, graphics, documentation, and other proprietary materials are owned by or licensed to EmojiKidz and may not be copied, modified, distributed, or commercially used without authorization.

16. Third-Party Services

Certain Services depend on cellular carriers, GPS networks, app stores, payment processors, shipping carriers, cloud services, and other third-party providers. EmojiKidz is not responsible for outages, service limitations, delays, or interruptions caused by third parties or circumstances outside our reasonable control.

17. Disclaimer of Warranties

Except for warranties expressly provided by EmojiKidz and rights that cannot be excluded by law, products and Services are provided on an "as available" basis. EmojiKidz does not guarantee uninterrupted cellular service, GPS accuracy, network availability, or error-free operation.

18. Limitation of Liability

To the fullest extent permitted by law, EmojiKidz will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use or inability to use our products or Services. Nothing in these Terms excludes or limits any rights or remedies that cannot legally be excluded or limited.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold EmojiKidz and its affiliates harmless from claims, losses, damages, or expenses resulting from your unlawful or unauthorized use of our products or Services, violation of these Terms, or infringement of another person's rights.

20. Suspension & Termination

EmojiKidz may suspend or terminate Services for nonpayment, fraud, misuse, unlawful activity, security concerns, violation of these Terms, or when reasonably necessary to protect customers, our systems, or third parties. Customer-requested cancellation is governed by the applicable subscription terms.

21. Governing Law

These Terms and any dispute arising from the use of EmojiKidz products or Services will be governed by applicable federal law and, where federal law does not apply, by applicable state law, without regard to conflict-of-law principles.

22. Changes to Terms

EmojiKidz may update these Terms from time to time to reflect changes to our products, Services, business practices, or legal requirements.
